Terms of Service

By using TalkToJesus (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

1) The Service

The Service provides devotional and informational content generated with AI. The Service is provided "as is" and "as available."

2) Eligibility

You must be at least 13. If you are under the age of majority, a parent or legal guardian must review these Terms.

3) Content and Data

No Accounts. We do not maintain user accounts. We store Input and Output on our servers and may associate them with device or session identifiers.
Input. You retain rights in Input; you license us to process it to provide and protect the Service.
Output. As between you and us, we own Output and license it to you broadly.
Service Data. We own logs, metrics, and related metadata.
Third-party providers. We use infrastructure and AI providers to process Input and deliver Output. Their terms and privacy practices apply to their services.

4) Acceptable Use

No unlawful, harmful, harassing, or infringing use.
No attempts to access non-public areas, interfere with the Service, or reverse engineer.
No use to build competing models or datasets without our written consent.

5) No Professional Advice or Emergencies

Content is devotional and informational only. It is not medical, legal, psychological, or pastoral advice. Do not use the Service for emergencies or crisis situations.

6) Changes and Availability

Features may change or be discontinued. We may update these Terms by posting a new version with a new effective date.

7) Intellectual Property

We and our licensors own the Service, including software, models, and content we provide. These Terms do not transfer any ownership of the Service to you.

8) Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF USD $50 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

10) Indemnity

You will defend and indemnify us from third-party claims arising out of Your Input, your use of the Service, or your violation of these Terms, to the extent permitted by law.

11) Termination

You may stop using the Service at any time. We may suspend or terminate access for any reason, including violations of these Terms.

12) Governing Law; Disputes

For users in the United States, these Terms are governed by New York law, excluding conflicts rules.

Arbitration and class-action waiver (U.S.). Any dispute will be resolved by binding arbitration on an individual basis administered by AAA or JAMS under their rules. No class or representative actions. Small-claims court remains available. You may opt out within 30 days of first accepting these Terms by emailing [email protected] with subject "Arbitration Opt-Out" and your device identifier. If arbitration is unenforceable for a claim, courts in New York County, New York have exclusive jurisdiction.

Where local law requires other terms, those mandatory rules apply to that extent.

13) Export and Sanctions

Do not use the Service in violation of export control or sanctions laws.

14) Miscellaneous

These Terms are the entire agreement for the Service.
If a term is invalid, the rest remain in effect.
No waiver unless in writing. You may not assign these Terms without our consent.
